Session 1: Navigating Privilege Considerations in Implementing Effective Corporate Compliance Programs - Join Alicia and David as they explore how compliance programs can have a variety of purposes and take a variety of forms depending on the nature of a company’s business and the regulatory framework within which it operates. Often times, complying with anti-bribery laws like the Foreign Corrupt Practices Act and other federal and state anti-corruption laws can at one time or another lead to internal investigations. They also discuss the Justice Department’s criteria for evaluating effective corporate compliance programs, Texas state and federal developments in attorney-client privilege and attorney work product, and practical considerations for the implementation of effective corporate compliance programs.
Session 2: What Do You Do When the Feds Show Up? - Hear basic advice for in-house counsel and corporate executives faced with federal raids, searches, investigation and arrest of employees, subpoenas to produce evidence or testify, and appearances in court.
Session 3: Handling and Responding to an Investigation (When Your Employees Are Remote) - As a result of the COVID-19 pandemic, many companies have transitioned important business functions from in-person to fully remote. Discuss key practical issues for companies to consider when carrying out investigations in the remote working environment.
Session 4: Deposition Preparation When Your Peers or Your Boss are the Witness - “Yes. No. I don’t know. I don’t recall.” Learn the top strategies for preparing your internal client, including other lawyers, for deposition, including issues relating to privilege, the latest requirements for corporate representatives, and handling depositions remotely.
Session 5: Enforcement Trends Across the Healthcare Industry - The federal government and various states continue to investigate and litigate healthcare fraud cases across all sectors of the industry. Hear an overview of the latest trends in enforcement and analyze what the new theories and trends mean for 2021 and beyond.
