Ethics and the Duty of Loyalty
The lawyer’s fiduciary responsibilities are at the core of ethics programs everywhere, and include the duty to refrain from conflicts of interest.  But in a modern society, where lawyers freely move between large firms with sophisticated clients, should the firm and client have a right to waive such traditional conflicts of interest to hire new talent? There is a growing movement to allow firms and lawyers to provide advance consent to situations which are currently barred by conflict of interest rules, as well as organized opposition to “taking the wrecking ball to client loyalty.” Find out what’s going on and see what you think!

  • Madison Street Energy LLC logo
    Madison Street Energy LLC
Madison Street Energy (‘MSE’) works with renewable energy project developers and landowners to provide financially efficient options with respect to how project land rights are obtained and maintained throughout a project’s life.

Specifically, with respect to project developers, MSE provides opportunities to save millions of dollars by offering them options to avoid the large upfront costs of acquiring land by structuring transactions ahead of time where MSE and the developer agree that MSE will purchase specific land sites targeted by developers so that MSE can immediately lease the target site back to the project owner for the however number of years it intends to actually use the property.

In addition, MSE dedicates a substantial amount of its business towards working with individual landowners that desire to sell the rights to their future energy lease income in exchange for a discounted lump sum cash payment. Despite the relative simplicity of these transactions, MSE continues to be sought after by landowners since there is no to readily accessible market for landowners to sell their lease receivables or pledge them as collateral for loans. That said, since MSE’s team is solely focused on this one niche area of renewable energy projects, it has attained unique level of insight on how best to assess and fairly value renewable energy receivables in a manner that often allows both the landowners and MSEs investors to feel very satisfied upon the closing of transactions.
